Freely choosing to download and use the “Get Instant Personal Loan App” mobile application (the “App”), binds you to the aforementioned privacy policy and the following terms and conditions (the “Terms”). Users are responsible for reading and understanding these Terms and should close The App if they do not agree or understand any aspect of them.

Loan Referral Service

The App’s lender connection process (the “Service”) aims to refer users to one or more lenders from our group of accredited lenders (the “Lender Partners”). The App requires users to fill out an online form (a “Request Form”) and press for submission before the Service can be delivered.

Personally-Identifiable Information (PII) is securely collected by The App, including the user’s name, address, phone number, email, job, income, wage frequency, and checking account details. How this information is used is governed by the Privacy Policy.

Credit Decisions

Only Lender Partners determine the loan amounts, interest rates, and other loan terms, based on their own internal criteria that are not shared with The App’s operator. The App does not function as a broker or lender and makes no lending decisions. It is at any Lender Partner’s discretion whether to make a loan offer or to approve a loan application, and The App makes no guarantee that a user will be connected with a lender or approved by them for a loan.

Completing and submitting a Request Form constitutes consent for PII to be securely distributed to the Lender Partners. The user also understands that submission amounts to a formal request for a loan offer from any of the Lender Partners. Consent to correspondence with Lender Partners is established until such a time you expressly opt-out. Communications may come in the form of email, SMS message, phone call, or snail mail, and can relate to a specific loan application or agreement, as well as loan offers, both now and in the future.

As part of the application and approval process, PII may be accessed by the Lender Partner’s qualified staff and/or subject to automated assessment techniques. Lender Partners reserve the right to carry out credit checks on prospective borrowers to verify the information and determine creditworthiness. Credit checks can be informal (a “Soft Check”), without recording a search on the user’s credit file, or formal (a “Hard Check”) that does record a search on the user’s credit file and could temporarily reduce the score, making it temporarily more difficult to obtain credit elsewhere. Equifax, Experian, and TransUnion are the most frequently used credit reporting agencies, but Lender Partners might also use a wide range of smaller agencies, including but not limited to DP Bureau, DataX, Microbilt, and Teletrack.

The user acknowledges and understands that submission of a loan Request Form may result in either form of credit check and permits Lender Partners to read, verify, assess, and otherwise research your PII as part of the application approval and loan offer process.

The user further acknowledges and understands that submission of a loan Request Form may result in automatic redirection to a Lender Partner’s website or another online service where a formal loan application may begin. The App is not privy to the application or the lender’s privacy policy, terms of use, and any other terms or policies.

Electronic Disclosure

Submitting a Request Form gives your consent to notifications, documents, forms, and other electronic disclosures, related to your loan request. Communications from The App and Lender Partners might be entirely online, and you agree that any online loan agreement that is electronically sent and signed by you is legally binding and holds the equivalent status of a physical contract and signature. At this stage, you agree that all further communications may be electronic and automated, including but not limited to crediting the loan and debiting the repayment, accessing the loan agreement and terms via the lender’s website or online services, and customer support correspondence. It is at the Lender Partner’s sole discretion whether you can withdraw consent to electronic disclosure or obtain paper copies of correspondence and documents. It is the responsibility of the user to request paper disclosure, while Lender Partners have the right to reject the request. Failure to consent to electronic disclosure may impede your ability to request and obtain a loan via The App and Lender Partners.

Accuracy

The user agrees at all times to provide true and accurate information, to the best of their knowledge at the time, whether that be via The App, Request Form, or Lender Partner’s website or online services. You agree not to willfully provide untrue or misleading information in order to obtain a loan or for any other reason. You agree that as a result of giving untrue or misleading information via The App, Request Form, or Lender Partner correspondence, you might be banned from The App, unable to connect to a lender, rejected for a loan, and/or permanently terminated from using the Service or requesting a loan from a Lender Partner.

Control over Features, Functions, and Access to the Service

The App’s Service might alter or update content, App features and functionality, and policies without giving warning. You may be blocked from using all or part of The App or Service with prior notice if The App deems at its sole discretion your behavior or activities are inappropriate or violate the Terms, rights of The App, or any relevant third party. User errors, mistakes, or miscomprehension of the Request Form that results in delays in providing the Service are not the responsibility of The App, nor does The App take responsibility for unforeseen technical problems or other glitches in the Service beyond its reasonable control.

The App AND ITS ASSOCIATED WEBSITE, INFORMATION, SOFTWARE, PRODUCTS, ONLINE SERVICES, AND LENDER PARTNER SERVICES, ARE PROVIDED “AS IS”. The App EXPRESSLY DISCLAIMS ANY WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, AS TO ANY MATTER WHATSOEVER RELATING TO The App AND ITS ASSOCIATED WEBSITE, INFORMATION, SOFTWARE, PRODUCTS, ONLINE SERVICES, AND LENDER PARTNER SERVICES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF NON-INFRINGEMENT, TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. The App MAKES NO WARRANTY AS TO THE END RESULT OF USING The App AND ITS ASSOCIATED WEBSITE, INFORMATION, SOFTWARE, PRODUCTS, ONLINE SERVICES, AND LENDER PARTNER SERVICES. YOU ACCEPT USING The App AND ITS ASSOCIATED WEBSITE, INFORMATION, SOFTWARE, PRODUCTS, ONLINE SERVICES, AND LENDER PARTNER SERVICES, IS AT YOUR OWN RISK. The App OR THE LENDER PARTNERS OR ADVERTISERS OR ANY OF THESE ENTITY’S CONTENT, SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, ASSIGNS, WILL NOT BE HELD LIABLE FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES OR ANY OTHER INJURIES AS A RESULT OF OR IN ANY WAY CONNECTED WITH THE USE OF The App OR ITS ASSOCIATED WEBSITE OR THE SERVICE OR WITH DELAYS OR INABILITIES TO ACCESS The App AND ITS ASSOCIATED WEBSITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, ONLINE SERVICES, AND LENDER PARTNER SERVICES OBTAINED THROUGH The App OR THE WEBSITE, OR OTHERWISE RESULTING FROM USING The App OR ASSOCIATED WEBSITE, WHETHER RESULTING IN WHOLE OR IN PART, FROM TORTIOUS BEHAVIOR, NEGLIGENCE, BREACH OF CONTRACT, STRICT LIABILITY OR OTHERWISE, EVEN IF The App OR THE LENDER PARTNERS HAVE BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

The App DOES NOT ENDORSE OR EXPRESSLY PROMOTE THE LOAN PRODUCTS OR OTHER SERVICES OF ANY LENDER OR OTHER THIRD PARTY. The App DOES NOT FUNCTION AS AN AGENT OR BROKER OF YOU OR ANY LENDER PARTNER. The App IS NOT PRIVY TO OR RESPONSIBLE FOR THE LENDER’S USAGE OR ASSESSMENT OF THE INFORMATION PROVIDED BY YOU VIA The App’s REQUEST FORM OR IN MAKING A DECIDING WHETHER YOU MEET THE CREDITWORTHINESS OF ANY PARTICULAR LENDER’S INTERNAL JUDGEMENT. ANY LENDER PARTNER IS SOLELY RESPONSIBLE FOR ITS SERVICES TO YOU, AND YOU AGREE THAT The App WILL NOT BE LIABLE FOR ANY COSTS OR DAMAGES OF ANY KIND RESULTING FROM YOUR USE OF THE SERVICE IN ANY WAY. YOU UNDERSTAND THAT LENDER PARTNERS MIGHT STORE YOUR REQUEST FORM INFORMATION, WHETHER OR NOT THEY APPROVE ANY APPLICATION FOR A LOAN WITH THEM. SOME US STATES DON’T GRANT THE LIMITATION OF LIABILITY AND DISCLAIMER OF IMPLIED WARRANTIES, SO YOU MIGHT NOT BE SUBJECT TO THE AFOREMENTIONED DISCLAIMERS AND LIMITATIONS. IN SUCH STATES, THE RESPECTIVE LIABILITY OF The App, THE LENDER PARTNERS, AND THEIR SERVICE PROVIDERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUBSIDIARIES, AFFILIATES, SUCCESSORS, AND ASSIGNS, ARE LIMITED TO THE GREATEST EXTENT GRANTED BY LAW.

Indemnity

You agree that by using The App, the Service, or associated website, to indemnify the App and the Lender Partners from and against any and all liabilities, expenses (including attorney’s fees) and damages resulting from claims against the App or associated website, including any claim that alleges facts that if true would be in breach these Terms by you.

Links to Third Parties

The App and associated website display external links and redirections to Lender Partner sites, other websites, and other third-party online services. The inclusion of these links is only for your reference and convenience and you are not compelled to follow them. The App is not in a position of control or operation of any of these third parties, as it pertains to their content, products, services, software, or management. Displaying a link to a third party does not constitute an endorsement of any of its content, products, services, software, management, or sponsoring organizations.

Dispute Resolution

All controversies or claims resulting from or relevant to using The App or associated website, the Service, or from any acts or omission for which you may claim the App is liable (a “Dispute”), is to be settled only by binding arbitration in line with the commercial arbitration rules followed by the American Arbitration Association at the time the claim is made. Any arbitration is to be held in Los Angeles, California and any judgment on the arbitration award is to be entered into a court of competent jurisdiction. No arbitrator will have the power to award damages relating to a Dispute exceeding the actual compensatory damages and will not inflate actual damages nor award exemplary, punitive, or consequential damages. All parties irrevocably waive all claims thereto. The agreement to arbitrate will not ever constitute a further agreement to join or consolidate this agreement’s arbitration with arbitration of dispute(s) or claims of any non-party, regardless of the alleged relevancy of said disputes to the initial arbitration.

BY AGREEING TO THESE TERMS, YOU RELINQUISH ANY RIGHT TO SETTLE ANY DISPUTE YOU HAVE WITH The App BEFORE A JURY OR OTHERWISE IN A COURT OF LAW. YOU FURTHER RELINQUISH ANY RIGHT TO TAKE PART IN OR BRING ABOUT CLASS ACTION LAWSUITS. YOUR USE OF The App and its SERVICE CONSTITUTES CONSENT TO THE AFOREMENTIONED RESTRICTIONS.

In case the above provisions are deemed unenforceable or inapplicable, or you file suit against The App, it is agreed that jurisdiction of the site of any lawsuit will only be in either the federal or state courts that sit in Los Angeles, California, and not another city or state. You further agree that despite any law or statute that says permits otherwise, any claim or cause of action resulting from or relevant to the use of The App or its services must be filed within one-year following said claim or cause of action occurring or be forever barred.

SMS Terms & Conditions

If you offer your cell phone number as part of your Request Form submission you recognize this as a formal opt-in to receiving correspondence by SMS from both the Lender Partners and The App. Such correspondence might contain a link to your completed loan Request Form, reminders for upcoming payments from the Lender Partner, and other loan offers in the future.

SMS correspondence may result in message and data rates. In these cases, The App, under no circumstances, will be held responsible for costs or fees levied by your cellular or wireless carrier, or any third parties that might charge you for this type of service.

Numerous reasons may cause delays in SMS messages or failure to deliver them entirely. Neither carriers nor The App is liable for slow or missed messages.

Other Terms

The above Terms represent the full agreement between The App and yourself. The laws and regulations of California govern these Terms regardless of its principles of conflict law. If any parts or provisions of these Terms is considered unenforceable by the appropriate law, then the null and void part or provision is to be replaced by an accurate and enforceable part or provision that most closely resembles the purpose of the initial part or provision, while all other Terms are still in effect. Any failing by The App or its operators to enforce or exercise any rights in these Terms shall not be considered a waiver of said right. The App further reserves the right to change these Terms without prior notice by publishing the amended Terms on The App and/or associated website. Upon going live online, these new Terms are automatically in effect.
